Culture and Law

Θυμήθηκα ένα κείμενο που είχα γράψει για έναν αλλοδαπό, πολύ γνωστό, εκδοτικό οίκο, για μια νέα σειρά που ενδιαφερόταν να εκδώσει. Όσο μικρό είναι, τόσο, αντίστροφα, πολύ είχα προσπαθήσει να το γράψω υπό μορφή σχεδόν ποιήματος (όπως είχαν αναγνωρίσει και οι υπεύθυνοι του εκδοτικού οίκου). Σκέφθηκα ότι μπορεί να σας ενδιαφέρει. Αφαίρεσα τα τμήματα που αφορούσαν στον εκδοτικό οίκο και στη σειρά που ετοίμαζε.

If we can see culture as a tall and never ending staircase, then a fan of law’s aspects will open before our eyes, the colorfulness of which will reveal the unbelievable wealth that is hidden behind each and every regulation of the human relations. It will reveal the wealth of the influences that visibly or invisibly lead to the enactment of concrete rules, influences that, reversely too, have to be deciphered while those rules are applied, since rules’ application presupposes their interpretation.

Cultural heritage law, in order to be[come] a protective blanket, on the one hand to the objects, material and immaterial, which constitute the essential property of the human communities, and on the other hand of those objects’ “circulation”, beyond the rules it has to take into consideration the tools and conclusions of other disciplines too, mainly of the social sciences and humanistic studies. Thus, the term “culture” becomes more translucent and more complete and the term “law” appears as that which really is: not only the concrete rules which regulate the concrete situations and relations, but also (and mainly) the various, explicit or implicit, factors which in the course of time determined, formed those rules.

Due respect to the biography of cultural objects needs and demands their legal protection, national and international.
