The Ecology of Law


Σκέφτηκα ότι οι φωτογραφίες που έβγαλα στη Μακρυνίτσα Πηλίου ταιριάζουν στη σημερινή ανάρτηση στην οποία θα αναφερθώ σε ένα πολύ ενδιαφέρον πρόσφατο βιβλίο - και πολύ πρόσφατα αποκτηθέν, πριν 3-4 ημέρες - το οποίο έχει ως άξονα μια πολύ πρωτοποριακή (ή ίσως μια πολύ ουσιαστική, ισχύουσα στο απώτερο παρελθόν) πρόταση για το μέλλον του δικαίου.

                                                     Όταν η φύση μιμείται την τέχνη...



Κάποια αποσπάσματα από το  βιβλίο:

"The first step in creating a new ecolegal order founded on systems thinking rather than on an outdated mechanistic way of thinking is to become aware of our own power to influence law through our aggregate action. This ecological vision of the law, as we suggest for the first time in this book, can have a tremendously empowering effect. It can unleash the "power of the people", reclaiming law as a common, to create a new ecolegal order that, following our systemic understanding of the world, can protect it for future generations." (p. 28)




"To be sustainable, human laws should serve, rather than exploit and plunder, the web of life. In law as in science, we must begin to focus on a relevant understanding of the whole rather than only the component parts. To achieve this goal, not only the laws of nature but also the nature of law should be understood by the general public." (p. 29)




"The current concentrated power structure will not concede any of these changes, which will ultimately decentralize power to small-scale communities in tune with the laws of ecology. Becausestructural changes do not happen by concession, the survival of civilization requires a revolution to move from a mechanistic, "pre-existing" law based on legal professionalism, capital, owners, and state sovereignty toward an ecology of law founded on social and natural relations and on community ownership. For such a revolution to happen, a dialogue between law and ecology is needed. Only the start of such a new dialogue can produce a coherent and clear way of thinking in the process." (p. 187)




Και κλείνει το βιβλίο έτσι:

"As the great jurist Oliver Wendell Holmes famously said:, "The life of the law has not been logic; it has been experience." If each struggle creates new institutional forms, if all practices of commoning learn from one another, and if commoners seize all possibilities of political impact according to the local politica conditions, the ecolegal revolution will arrive sooner than expected. Ecology shows us that sometimes it takes a fire to regenerate a sick forest. The current legal system, which is institutionalizing extraction and devouring our future, is like rotten wood that is very difficult to set on fire. Any single strategy is likely to fail, as when one tries to light a fire with only one match. Many different attempts to light it, small as they might appear, will be successful, if all work together for a common and clear purpose of emancipation from the mechanistic vision of law. Insurgencies without a vision are just desperate riots - easy to delegitimize and to repress with the violence of current law. Ecolaw is ready now to endow the 99 percent with a vision and a plan." (p. 188)




Για να το θέσω με σχήμα λιτότητας (αν και δεν έχω διαβάσει το βιβλίο κανονικά, μόνον αποσπασματικά): δεν με βρίσκουν αντίθετη οι σκέψεις και θέσεις αυτές, καθόλου αντίθετη μάλιστα!
